The petitioner seeks bail in connection with Ara Rail P.S. Case No. 98 of 2019, registered under Section 379/34 and 411 of the Indian Penal Code.

The accusation is that on 28.06.2019, while informant Pradeep Paswan was taking ticket at Ara railway station, in the meantime, three boys came and stand behind him, out of them, one boy took his mobile from his pocket and handed over to the same to other boy. The boy, who had taken mobile from his pocket was identified by him and with the help railway Police, he was apprehended, who disclosed his name Samru Paswan.

Learned counsel for the petitioner submits that

In course of investigation, co-accused Samru Paswan disclosed the name of his two associates as Arjun Kumar (Petitioner) and Manish Kumar saying that they were present at the time of taking mobile from the pocket of informant. Further submission is that petitioner has no criminal antecedent and he is in custody since 25.08.2019. Further submission is that after investigation, the Police has already submitted Chargesheet.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ara Rail in connection with Ara rail P.S. Case No. 98 of 2019. Out of two sureties, one surety must be parents/close relative of the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
