This is a case of misuse of privilege of bail. Petitioners seek bail in connection with Nasriganj P.S. Case No. 68 of 2006 registered for the offence punishable under sections 323, 341, 406/34 of the Indian Penal Code. Learned counsel appearing for the petitioners submits that previously the petitioners were on bail but due to lack of information they could not make proper pairvi in the case and consequently their bail bonds were cancelled. Petitioners had gone out of the State to earn their livelihood. On getting information about cancellation of their bail

Patna High Court CR. MISC. No.84809 of 2019(2) dt.20-01-2020 2/2 bonds, they voluntarily surrendered in the Court. It is further submitted that charge has already been framed in this case and petitioner is ready to co-operate in the trial. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 68 of 2006, Tr. No. 1204 of 2018 with condition that petitioners will co-operate in the trial and appear on each and every date fixed in the trial. In case petitioners fail to appear on two consecutive dates in the trial without prior permission of the Court, the Court below shall be at liberty to take steps for cancellation of their bail bonds.
