JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Koilwar P. S. Case No. 303 of 2019 disclosing offences under Sections 341, 147, 148, 307, 504, 506 of the Indian Penal Code.

As per prosecution case, petitioner no.1 assaulted by bat portion of the pistol to the informant and petitioner no.2 is also named in the F.I.R.

Submission of the learned counsel for the petitioners is that no case is made out under Section 307 of IPC, which will appear from the fact that had it been any intention to kill, he would have fired on him.

Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer for anticipatory bail.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Bhojpur, Ara, in connection with Koilwar P. S. Case No. 303 of 2019.
