The petitioner seeks regular bail in connection with Kopa P.S. Case No. 204 of 2019 for the offence registered under Sections 272, 273 and 120(B) of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of huge quantity of illicit liquor from a truck which was apprehended by the Police and upon the co-accused persons being interrogated, after they were apprehended from the place of occurrence, it transpired that the illicit liquor was to be supplied to the petitioner and others.
The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in

No.85467 of 2019(2) dt.07-01-2020 2/2 the present case inasmuch as neither the illicit liquor belongs to the petitioner nor the truck belongs to the petitioner and merely upon suspicion the petitioner has been roped in the present case without any rhyme or reason. It is further submitted that the petitioner has got no complicity in the alleged occurrence. Lastly, it is submitted that the petitioner is languishing in custody since 04.12.2019.
Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct the petitioner herein to be released on bail.
Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Saran in connection with Kopa P.S. Case No. 204 of 2019.
