====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-01-2020 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners in the present case are seeking anticipatory bail in connection with Govindpur P.S. Case No. 155 of 2019 registered for the offences punishable under Sections 304/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. Learned counsel submits that the allegation against the petitioners that they were unauthorizedly using the electricity is false and baseless.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.85289 of 2019(2) dt.09-01-2020 2/2 Considering the facts and circumstances of the case where there is allegation against the petitioners that they were unauthorizedly using the electricity by connecting the open wire through the field and because of the current flowing from the same, the son of the informant died, there being an observation of the learned Additional Sessions Judge-VI, Nawada that witnesses have stated that electricity line of the petitioners was disconnected because of non-payment of bills and the petitioners while moving this Court have not controverted and have not shown to this Court that they were having valid electricity connection in the field, there being a casualty because of the alleged illegal connection being drawn by these petitioners which caused death of the son of the informant, I am not inclined to grant anticipatory bail to the petitioners. Prayer is refused.

In case, the petitioners surrender and pray for regular bail in the court below within a period of four weeks from today, their prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court. arvind/vats (Rajeev Ranjan Prasad, J) U T
