====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-01-2020 Petitioner No. 1 Chutun Pandey @ Dhananjay Pandey has already been arrested. Hence, his prayer for anticipatory bail is dismissed as infructuous. Heard learned counsel for the petitioner no. 2 and 3 and learned Additional Public Prosecutor for the State. The petitioner no. 2 and 3 are apprehending their arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. So far other petitioner no. 2 and 3 are concerned, they have got no criminal antecedent and recovery of liquor is alleged from a field which is not of the petitioners. Considering the fact that there is no substantial material against the petitioner no. 2 and 3 for this purpose, let

No.84772 of 2019(2) dt.07-01-2020 2/2 the petitioner no. 2 and 3, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sidhwalia Police Station Case No. 214 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 2 and 3 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 2 and 3.
