2. Petitioner seeks regular bail in connection with Baheri P.S. Case No. 345/ 2025 registered for the offence(s) punishable under Sections 126(2), 115(2), 118(1), 109(1), 74, 303(2), 351(2), 352 and 3(5) of the BNS. Later on section 103(1) of the BNS was added vide order dated 01.09.2025.

3. The main submissions advanced by the petitioner's counsel are that though the petitioner's role has been alleged in the first part of the FIR relating to the offence of loot but the informant has also revealed therein that petitioner returned some parts of the looted articles to the informant and so far as the second part of the occurrence relating to the murder of the deceased is concerned, no role of the petitioner has been revealed and he has been languishing in jail since 22.08.2025,

Patna High Court CR. MISC. No.90146 of 2025(2) dt.13-01-2026 2/2 the investigation against him has been completed and though, against him there is criminal antecedent of one case but he is on bail in the said case.

4. The learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the above submissions advanced by the petitioner's counsel, averments made in this petition, the petitioner's custody period and the completion of investigation against him coupled with his role in the alleged offence, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Baheri P.S. Case No. 345/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
