The petitioner apprehends his arrest in a case registered under Sections 364, 302, 201, 120(B) of the Indian Penal Code.

Earlier anticipatory bail application of the petitioner was rejected vide Annexure-1 to the present application with a direction to surrender in the court below and pray for regular bail. In the light of said direction, the petitioner seeks permission to withdraw the present application with liberty to surrender in the court below and pray for regular bail. It has

Patna High Court CR. MISC. No.1446 of 2020(5) dt.18-06-2020 2/2 further been submitted on behalf of the petitioner that from perusal of Annexure-3, it is evident that the petitioner is a handicapped person.

Considering the aforesaid submissions made on behalf of the petitioner, this court is not inclined to interfere with the earlier order annexed as Annexure-1 to the present application, passed by a coordinate bench (then His Lordship was) of this court.

Accordingly, the present application filed in connection with Sakra P.S. Case No. 63 of 1997 stands dismissed.

If the petitioner surrenders in the court below and prays for regular bail, the court below, while passing the order, shall take into account the Annexure-3 of the present application.
