The petitioner seeks regular bail in connection with Shikarpur P.S. Case No. 386 of 2019 for the offence registered under Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation is regarding recovery of one country made loaded pistol with a live cartridge from a room from where the petitioner and four others co-accused persons were arrested.

The learned counsel for the petitioner has submitted that the petitioner is innocent and neither recovery of the illegal arms has been made from the petitioner nor the said arms belongs to the petitioner. It is further submitted that the petitioner has been falsely implicated in the present case and he

Patna High Court CR. MISC. No.84632 of 2019(2) dt.19-12-2019 2/2 is languishing in custody since 10.09.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 386 of 2019.
