The petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 305 of 2019 G.R. No. 1354 of 2019 for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

The allegation is regarding recovery of 273.500 liters of illicit liquor from Indigo vehicle and the petitioner is stated to be driver of the said vehicle.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 19.11.2019. Having regard to the facts and circumstances of the case

Patna High Court CR. MISC. No.85734 of 2019(2) dt.14-01-2020 2/2 and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VII-cumSpecial Judge, Excise, Aurangabad in connection with Nabinagar P.S.
