The petitioner seeks regular bail in connection with Amarpur (Fullidumar) P.S. Case No. 545 of 2019, registered for the offence punishable under Sections 147, 148, 149, 323, 307, 337, 379, 385 and 504/506 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner herein having assaulted the brother of the informant resulting in him sustaining head injury. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 27.10.2019. It is further submitted that the present case arises out of case
Patna High Court CR. MISC. No.575 of 2020(2) dt.16-01-2020 2/2 and counter case, the case filed by the uncle of the informant being first in time. It is further submitted that though three accused persons are stated to have assaulted the brother of the informant, but only one injury has been found on the person of the injured.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent and the uncle of the informant has filed a case prior to the present one and the present case is stated to be a counter blast case, I deem it fit and proper to direct for release of the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar) P.S. Case No. 545 of 2019.
