Petitioner seeks bail in Goh P.S. Case No.10 of 2019 registered under Sections 302, 304B, 201 and 34 of the IPC. The brother of the deceased disclosed that his sister was married to Lal Bahadur Choudhary in the year 2013. His sister got two children from the wedlock. On 10.01.2019 the informant received information that his sister was killed and her dead body was concealed. On such, the informant went to the house of the deceased sister and came to know that the petitioner inflicted sword blow killing his sister on the spot. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased. The informant has not disclosed in his information from whom he got information
Patna High Court CR. MISC. No.2013 of 2020(4) dt.19-06-2020 2/2 about killing of his sister. The informant is not an eye witness of the occurrence. The petitioner is in jail since 12.01.2019, but from perusal of the F.I.R. and the case diary, it appears that the petitioner mercilessly inflicted different blows on his wife killing her on the spot. The wrist was chopped off and she was consigned to flames in order to obliterate the evidence. The witnesses including the children of the deceased very categorically alleged that it was petitioner who inflicted blows killing the deceased on the spot. The petitioner mercilessly inflicted different blows on the head and other parts of his wife and killed her on the spot and later on she was consigned to flames.
Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
