Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
Petitioner is named in the first information report with allegation that he called the deceased and subsequently, the deceased was killed by the petitioner and others. However, after due investigation police found insufficient evidence and submitted final form in favour of the petitioner and others. The concerned Magistrate differed with the findings of the police
Patna High Court CR. MISC. No.86838 of 2019(4) dt.19-03-2020 2/2 and took cognizance of the offence against the petitioner and even if, prosecution story assumed to be true, then also, it is case of last seen.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 208 of 2019.
