Petitioner is apprehending his arrest in connection with Complaint Case No.899 of 2019 , registered for offences punishable under Section 498A of the Indian Penal Code. As per the complaint case, petitioner happens to be husband of the complainant and he has a female child also. There is allegation of demand of one motorcycle and for that subjecting her to cruelty. On the other hand the stand of the learned counsel for the petitioner is that petitioner is still ready to keep her and for that he has filed a petition for restitution of the conjugal rights also but she refused to reside with the
Patna High Court CR. MISC. No.207 of 2020(2) dt.23-01-2020 2/2 petitioner even before the Sessions Judge he has taken that stand and the girl has appeared and she has flately refused to reside with the petitioner on the ground of cruelty. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Smt. Amrita Singh, J.M. Ist class, Kaimur (Bhabua) in connection with Complaint Case No.899 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
