The petitioner apprehends his arrest in G.B. Nagar P.S. case No. 261 of 2019 registered under Section 413, 414/34 of the IPC.

The informant, on the basis of information received, raided the village, Nautan on the allegation that petitioner and other accused persons are indulged in trade of stolen motor cycle. The house of petitioner was also raided and one motor cycle from the verandah of the house was recovered. The learned counsel for the petitioner submits that similarly situated accused, Dhrub Shanker Dubey, has already been granted anticipatory bail on the ground that motor cycle was recovered from open space and not from the premises of the

No.216 of 2020(3) dt.03-03-2021 2/2 house of Dhrub Shanker Dubey but from perusal of the records, it appears that one stolen motor cycle was recovered from the verandah of house of the petitioner and the petitioner could not be able to show any document with regard to ownership of the motor cycle.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
