Counsel for the petitioner submits that he would approach the appellate authority, namely, Divisional Commissioner, Tirhut Division, Muzaffarpur against the order dated 09.10.2019 passed by the District Magistrate, Sitamarhi. In view of such submission, this court would only observe that appellate authority should consider the appeal in the background of petitioner's claim for parity reiterated in the order dated 24.06.2011 passed in CWJC No. 582 of 2009, if filed within a period of four weeks from today. The same should be considered on merits without raising issue of delay.

Patna High Court CWJC No.1136 of 2020(2) dt.14-02-2020 2/2 Appeal should be disposed of expeditiously, without any undue delay and preferably within a period of eight weeks thereafter.
