JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-02-2026 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State.
2. The petitioners seek regular bail in connection with Barsoi P.S. Case No. 233 of 2025 for the offences registered under Sections 103(1), 3(5) of the B.N.S.
3. As per the prosecution case, daughter of the informant was killed by the petitioners (in-laws).
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Petitioners are in-laws of the deceased. Informant is not

Daughter of the informant was married with co-accused Madan Karmakar ten years ago having two children. Husband of the deceased is already in custody. Petitioners have no criminal antecedent. Petitioner Nos. 1, 2 and 3 are in judicial custody since 19.09.2025 and Petitioner No. 4 is in judicial custody since 13.10.2025. Petitioners were living separately from the deceased and her husband. They have no concern with the family affairs of the deceased and her husband.
5. Learned counsel appearing on behalf of the State and learned counsel for the informant oppose the prayer for grant of bail to the petitioners.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case, petitioners are inlaws and period of custody undergone by the petitioners, let the petitioners, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1, Katihar in connection with Barsoi P.S. Case No. 233 of 2025.
