The petitioner is languishing in custody since 23.06.2019 in a case registered for the offences punishable under Sections 8/20(B) (ii) (b) of NDPS Act.

It is alleged that from the possession of the petitioner two packets of 500 gms each charas were recovered. The recovery of charas is not in dispute.

Considering the fact that the commercial quantity of recovery has been made from the possession of the petitioner, hence, in view of the embargo under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner in connection with Sathi P.S. Case No. 75 of 2019, pending in the Court of learned District & Sessions Judge, West Champaran, Bettiah.

Patna High Court CR. MISC. No.85889 of 2019(3) dt.19-03-2020 2/2 Accordingly, the prayer for bail of the petitioner is rejected.
