JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Mahua P.S. Case No. 99 of 2019, registered for offences punishable under Sections 304(B) and 376 of the Indian Penal Code.

Petitioner happens to be elder brother in law of the daughter of informant and it is alleged that he had evil eye on her and he was trying to establish physical relationship with the daughter of informant. Later on the informant was informed on telephone that her daughter has been done to death, upon which, the informant came and found her dead body and it is alleged that she was raped and, thereafter, killed.

It has been submitted on behalf of the petitioner that no external or internal injury was found in postmortem and viscera was preserved. Further submission is that petitioner is elder

Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail on the ground that earlier also, illicit advances were made by the petitioner, for which, a panchayati was also held. However, learned A.P.P. admitted that in the inquest report, nothing incriminating has come Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 99 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
