In this case, the petitioners are seeking anticipatory bail in connection with Kuchaikot P.S. Case No.268 of 2019, registered for the offence punishable under Sections 304 (B)/34 of the Indian Penal Code.
Within four months of marriage, the lady had been killed by strangulation. During discussion, it appears that the husband lives outside the India and all the petitioners live in the house and she had been killed.
Considering the facts and circumstances of the case,
Patna High Court CR. MISC. No.331 of 2020(2) dt.25-02-2020 2/2 the prayer for bail of petitioner nos. 1 & 2, namely, Lilawati Devi @ Gitawali Devi and Shobha Kumari is hereby rejected. As the petitioner no.3, namely, Neha Kumari is minor, let she be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kuchaikot P.S. Case No. 268 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
