Mr.Sanjay Kumar Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-09-2020 Heard Mr. Jeetendra Narayan, learned counsel for the petitioners and Mr. Sanjay Kumar Tiwary, the learned Additional P.P. through video conferencing.

The petitioners apprehend their arrest in Manjhi P.S. Case No.142 of 2019, registered under Sections 341, 323, 307, 324, 379 and 34 of the Indian Penal Code.

The informant in sum and substance alleged that her husband asked the accused persons to slow the sound of DJ Box, but the accused persons including the petitioners having armed with different weapons came and assaulted the informant, her husband and sons.

Learned counsel for the petitioners submits that there is counter version being Manjhi P.S. Case No.143 of 2019. Some verbal altercation took place between the two sides and both the sides entered into scuffle with each other. The injuries

The learned Additional P.P. however, opposed the prayer for anticipatory bail.

It appears that the informant named the petitioners along with other accused persons and made omnibus and general allegation of assault with different weapons such as garasi, farsa lathi and danda but the injuries found on the persons of the informant, her husband and sons are simple in nature caused by hard and blunt object.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Manjhi P.S. Case No.142 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
