JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Goraul P.S. Case No.25 of 2019 for the offenses under Section 392 of the Indian Penal Code.
Allegation against the petitioner is that he along with others has looted money from the cash counter. Learned counsel appearing on behalf of the petitioner would submit that FIR was lodged against unknown. The name of the petitioner surfaced on the confessional statement of coaccusedManto Kumar. The petitioner is in custody since 12.07.2019 yet he has not been put on TIP.
Considering the fact that the petitioner was not named in the FIR. He has remained in custody since 16.11.2018 yet he
Patna High Court CR. MISC. No.84798 of 2019(4) dt.04-06-2020 2/2 has not been put on TIP, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1st, Vaishali at Hajipur in connection with Goraul P.S. Case No.25 of 2019, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of three months. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Vaishali at Hajipur, who shall utilize his services appropriately.
