The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 323, 341, 504, 498 (A), 494, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Prosecution case is that as per FIR, the informant Nutan Kumari was married on 09.07.2010 with Shiv Kumar Singh by gift cash and other house hold articles. After marriage her in-laws members started demanding motorcycle and two kathas land. They tortured the victim for non-fulfillment of their demand. Her father gave 50 thousand for purchasing

Patna High Court CR. MISC. No. 85227 of 2019(2) dt.14-02-2020 2/3 motorcycle. On 30.08.2015 her in-laws family members locked her in a room and tried to kill with various ways. She returned to her Maike. Her father alongwith other relatives went to her Sasural for pacify the matter where they learnt that her husband has solemnized his re-marriage with the widow of her brother. On 07.06.2019, when, she met with her husband and his second wife at Kaliasthan Chowk they abused the victim and made assault by fists and slaps.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and they have been falsely implicated in this case. Petitioner no. 1 is mother-in-law, petitioner no. 2 is father-in-law and petitioner no 3 is Devar of the informant. There is no specific allegation against the petitioners. All petitioners are living separately and they have no connection with the personal live of the informant. Only the husband is sole responsible for the allegation as alleged by the informant in the FIR.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty
