JUSTICE ARUN KUMAR JHA ORAL ORDER 13-07-2026 Learned counsel for the petitioner submits that no reconciliation has been done between the petitioner and the opposite party before the Court of learned Principal Judge, Family Court, Munger in Maintenance Case No. 136 of 2024.
02. Learned counsel also submits that petitioner plies an e-rickshaw and is not in position to make payment of Rs.10,000/- per month as interim maintenance and litigation cost of Rs.40,000/- in lumpsum to the opposite party. Learned counsel further submits that the petitioner is ready to keep his wife.
03. Since the petitioner has approached this Court against order dated 22.11.2025 passed by learned Principal Judge, Family Court, Munger whereby and whereunder the petitioner has been directed to make payment of Rs. 10,000/-
Patna High Court CR. REV. No.1373 of 2025(2) dt.13-07-2026 2/2 per month as interim maintenance and Rs. 40,000/- as litigation cost in four installments, as the petitioner submits that no conciliation proceedings have been taken up before the learned Principal Judge, Family Court, Munger. Petitioner is directed to make payment of half of the amount in terms of order dated 22.11.2025 passed by the learned Principal Judge, Family Court, Munger and the learned Principal Judge is directed to take up conciliation process between the petitioner and the opposite party. If the conciliation is successful, appropriate orders will be passed by the learned Principal Judge, Family Court, Munger. In case, it fails, then the learned Principal Judge, Family Court, Munger will proceed in the matter and pass appropriate orders and in case of failure of conciliation, the petitioner would be liable for payment of balance of the interim maintenance order in terms of order dated 22.11.2025.
04. Accordingly, the present petition stands disposed of.
