2. Petitioner seeks bail who is in custody since 30.07.2025 in connection with Gangta P.S. Case No. 86 of 2025, F.I.R. dated 30.07.2025 for the offences punishable under Sections 25(1-A), 25(1-AA), 25(1-B)a, 26(i)(ii) and 35 of the Arms Act.

3. According to prosecution case, on a raid being conducted, the petitioner along with other accused persons are found to have been involved in the illegal manufacturing of arms.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the

Patna High Court CR. MISC. No.503 of 2026(4) dt.06-04-2026 2/2 present case. The allegation as alleged in the F.I.R is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R. He further submits that the petitioner is working in the factory in question and he has no role at all in the present occurrence.

The learned Additional Public Prosecutor on the material available on record and the case diary has vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R, it appears that altogether 43 items were recovered from the place of occurrence which suggests the involvement of the petitioner in the present crime in question and number of half manufactured arms were also recovered from the place of occurrence. Apart from that the petitioner carries one criminal antecedent other than the present one.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Gangta P.S. Case No. 86 of 2025 pending in the court of learned A.C.J.M-II, Munger.

7. Prayer is refused.
