JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2020 The petitioner seeks regular bail in connection with Dhamdaha P.S. Case No. 294 of 2019, registered for offences punishable under Section 307 of the Indian Penal Code and section 25(1-b)a, 26 and 27 of the Arms Act.

Allegation as per F.I.R is that on demand by the Hawker for the payment of Ice Cream, the petitioner fired on him, though firing made by the petitioner did not hit anybody, thereafter, he was apprehended on spot and there is recovery of one country made pistol, two live cartridges and seven empty cartridges and apart from that he is accused in three other cases. It has been submitted on behalf of the petitioner that in one of the case, he has been acquitted and so far this case is concerned, he has falsely been made accused and has been in custody for six months and chargesheet has been submitted.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 294 of 2019.
