2. Learned counsel for the petitioner submits that the privilege of anticipatory bail had been granted by order dated 02.09.2019. However, the petitioner presently serving in 102 Battalion BSF at Trehgam C/o APO, District- Kupwara, StateJammu & Kashmir-193224 under Army Control was engaged in his duty at the time and was not granted leave, as a result of which he was unable to surrender before the learned Court below within the stipulated time in terms of the order of anticipatory bail. It is stated that the petitioner is presently on

Patna High Court CR. MISC. No.86739 of 2019(2) dt.13-01-2020 2/2 leave.

3. Having regard to the submission of the petitioner, the time for surrender and furnishing bail bond granted in terms of order dated 02.09.2019 in Cr. Misc. No. 55412 of 2019 is extended by four weeks from today.

4. Cr. Misc. No. 86739 stands disposed of.
