Petitioner, who is in custody, seeks bail in a case, registered for the offence punishable under Sections 399, 402 and 34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Informant has alleged that on specific information that some miscreants have assembled to commit robbery in Bank, he reached said place and accused assembled there tried to flee away on two motorcycles, however, one fell down and he was apprehended and from his possession one country made pistol with two live cartridges were recovered.

As arms and ammunition has been recovered from the possession of the petitioner and he has also criminal antecedent,

Patna High Court CR. MISC. No.1776 of 2020(2) dt.14-01-2020 2/2 I am not inclined to grant regular bail to the petitioner. Accordingly, this application is rejected.

However, after one year of custody petitioner would be at liberty to renew his prayer for bail.
