In the instant petition, the petitioner has prayed for anticipatory bail in connection with Kharagpur P.S. Case No. 298 of 2019 punishable for the offences under Sections 498A/34 of the Indian Penal Code pending before the Additional Chief Judicial Magistrate-IV, Munger.

It is accusation to know that the petitioner has not revealed the date of marriage in support of grant of anticipatory bail for the offences punishable under Section 498A/34 of the Indian Penal Code. Therefore, the petitioner has not made out a case so as to grant anticipatory bail in support of the offences under Section 498A/34 of the Indian Penal Code. It is one of the serious offences in the society. The Apex Court judgment in the case of Nathu Singh vs. the State of Uttar Pradesh reported in

Patna High Court CR. MISC. No.119 of 2020(3) dt.03-11-2021 2/2 (2021) 6 SCC 64 has taken note of identical matter that the Courts shall not grant interim protection under Section 438 of Cr.P.C.

In the light the case of Nathu Singh (supra), the petitioner has not made out a case to grant anticipatory bail. Accordingly, the petition stands dismissed reserving liberty to the petitioner to approach for bail before the jurisdictional court. (P. B. Bajanthri, J) Vikash/- U T
