The petitioner in the present case is seeking regular bail in connection with Jokihat (Mahalgaon) P.S. Case No. 274/2018 registered under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case on mere suspicion. Learned counsel submits that the dispute was there with the deceased over certain transactions and the said Rabesh has been specifically named in the F.I.R. has been granted regular bail by learned coordinate Bench of this court in Cr. Misc. No. 60664/2019 and the co-accused Naushad @ Md. Naushad has been granted regular bail by learned coordinate
Patna High Court CR. MISC. No.84940 of 2019(2) dt.09-01-2020 2/3 Bench of this court in Cr. Misc. No. 6898/2019. Petitioner is in custody since 15.09.2019 having no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for bail.
Considering the facts and circumstances wherein it is the submission of learned counsel for the petitioner that save and except on mere suspicion and that the co-accused Akbar had given a call on the mobile of this petitioner and he had made statement taking name of this petitioner, there is no other material to connect this petitioner with the present case, further submission that police had recovered the motorcycle of the deceased from the house of Arif, the brother-in-law of coaccused Naushad, and it came to know that the motorcycle was given to the said Naushad and further that the co-accused Rabesh with whom it is alleged that the dispute was there with the deceased over certain transactions and the said Rabesh has been specifically named in the F.I.R. has been granted regular bail by learned coordinate Bench of this court in Cr. Misc. No. 60664/2019 and the co-accused Naushad @ Md. Naushad has been granted regular bail by learned coordinate Bench of this court in Cr. Misc. No. 6898/2019, let the above-named petitioner be released on bail furnishing bail bond of Rs.
Patna High Court CR. MISC. No.84940 of 2019(2) dt.09-01-2020 3/3 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jokihat (Mahalgaon) P.S. Case No. 274/2018, subject to the condition as laid down under Section 437(3) Cr.P.C. as under:
(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer or tamper with the evidence.
