Petitioner is in custody in connection with Adhaoura P.S. Case No. 39 of 2019 for the offence under sections 324, 307 and 504 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 30.08.2019.

The allegation against this petitioner is that he has opened fire which caused injury to the informant. Learned counsel for the petitioner submits that the kind of injury sustained is simple in nature. He also submits that due to land dispute, the petitioner has falsely been implicated in this case.

No.85913 of 2019(2) dt.28-01-2020 2/2 Considering the fact that petitioner is in custody since 30.8.2019 and he has remained in custody for nearly five months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000 (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Adhaoura P.S. Case No. 39 of 2019 subject to the condition that bailors should be family members of the petitioner.
