JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 Petitioner seeks regular bail in connection with Bikram P. S. Case No. 214 of 2019 registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. As per F.I.R. police on information of preparation of dacoity, raided the place of occurrence and there is recovery of 315 bore one country made pistol with one live cartridge as well as one stolen motorcycle.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case at the instance of the police. He is in custody for six months, having no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides, in view of the submissions,

Patna High Court CR. MISC. No.87051 of 2019(2) dt.14-01-2020 2/2 made above, I am not inclined to grant bail to the petitioner at this stage. However, once the charge has been framed, he is at liberty to renew his prayer for bail.

With the above observations, this application is dismissed.
