ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.10.2019 in connection with Khaira P.S. Case No.371 of 2019 registered for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30, 30(a), 40(i), 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the bush near the brick-kiln of Manpur village. The petitioner is not having any criminal antecedents. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)
