2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 377,354B,506/34 of the Indian Penal Code and section 4 of the POCSO Act.

3. As per prosecution case, petitioner and his associate Md. Sarfaraz forcibly took 9 years old minor son of informant in the lap. Thereafter, they committed indecent act with him and inserted danda in his anus. Blood started oozing out and victim became senseless. However, after hours together when her son became conscious, then he narrated all the story to his mother. Thereafter, her mother went to the house of this petitioner and complained the matter. Accused persons abused and assaulted the informant.

Patna High Court CR. MISC. No.91219 of 2025(6) dt.14-07-2026 2/2 implicated in this case since there is land dispute between the parties since long. Medical Board did not find any external injury on the body of the victim. Petitioner claims clean antecedent.

5. Learned counsel for the State opposed the prayer for bail. The victim in her statement recorded under section 183 Bharatiya Nagarik Suraksha Sanhita, 2023 has supported the prosecution case. Several witnesses, during investigation have supported the alleged offence.

6. Considering the nature and gravity of accusation and 183 BNSS statement of the victim, prayer for bail of the petitioner is rejected.
