Kamal P.S.Case No. 97 of 2019 registered for the offences punishable under Sections 456, 354B and 379 of the Indian Penal Code. As per FIR there is allegation against the petitioner that he tried to drag the informant and snatched her gold ear rings and chain though later on charge sheet has been submitted under Section 376 and other sections of the IPC. Submission of learned counsel for the petitioner is that after 10 days of the occurrence the statement of victim was recorded under Section 164 Cr.P.C. in which she has made allegation of rape though she has not stated so in her first statement, apart from that paragraphs 27 and 29 of the case diary disclosed that there is enmity between the parties from before and he is in custody since 13.9.2019 and charge sheet has

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with S. Kamal P.S.Case No. 97 of 2019.
