JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-01-2020 The appellant was granted bail by this Court vide order dated 16.11.2019, passed in Criminal Appeal (SJ) No. 3388 of 2019, in A.B.P. No. 166 of 2019, arising out of Barachatti (Mohanpur) P.S. Case No. 166 of 2018 (Tr. No. 92 of 2019) with a direction to surrender before the court below within a period of three weeks from the date of passing of the order and furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount. The learned counsel for the appellant has approached this Court through the present petition seeking extension of time for surrendering before the court below.

For the reasons stated in the application for

Patna High Court CR. MISC. No.41 of 2020(2) dt.20-01-2020 2/2 the extension of time, the prayer is allowed. The order dated 16.11.2019 is modified to the extent that if the appellant, above named, surrenders before the learned court below within a period of three weeks from today, he shall be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, SC/ST, Gaya in A.B.P. No. 166 of 2019, arising out of Barachatti (Mohanpur) P.S. Case No. 166 of 2018 (Tr. No. 92 of 2019).

Rest of the conditions, if imposed in the order dated 16.11.2019, shall subsists.

With the aforesaid modification, the application stands allowed.
