The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR, on 16.11.2018 at about 4 PM when the informant along with his brother/deceased went to Hira Tola Ghat, petitioner along with other co-accused persons altogether 11 in number dragged his brother namely Larku Rai and fired upon his head causing injury in his head resulting to his death. Submission of learned cousnel for the petitioner is that altogether eleven persons said to have fired and no specific allegation has been attributed to the petitionerand co-accused having similar allegation has already been granted the privilege

Patna High Court CR. MISC. No.85331 of 2019(4) dt.18-03-2020 2/2 of anticipatory bail by a coordinate Bench of this Court vide order dated 01.04.2019 passed in Cr. Misc. No. 19513 of 2019 and order dated 05.07.2019 passed in Cr. Misc. No. 41570 of 2019.

In the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class Danapur, Patna in connection with Maner P.S. Case No. 620 of 2018.
