Mr. Ramadhar Singh, G.P-25 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIBEK CHAUDHURI ORAL ORDER 14-05-2026 I have heard the learned Advocate for the petitioner and the learned Advocate for the State.

2. The instant contempt application has been filed for non-compliance of the order by the petitioner of Criminal Revision No. 64 of 2025, on 30.07.2025, directing the petitioner to pay maintenance at the rate of Rs. 39,640/- per month to the opposite party from the date of filing of the application.

3. It is recorded in clear term that no contempt lies against non-compliance of the order passed in Criminal Revision No. 64 of 2025, directing the petitioner's husband to pay maintenance allowance to his wife.

4. Thus, the order passed in revision is executable and the only remedy for the wife is to file an execution case.

5. It is submitted by Ms. Shilpi Keshri, learned Advocate on behalf of the petitioner that the wife/petitioner herein has already filed an Execution Case No. 194 of 2025 but the said case is not being proceeded with so that the wife/petitioner can get the maintenance allowance.

6. The learned Principle Judge, Family Court, Aurangabad, is directed to take up the Execution Case No. 194 of 2025 at the earliest and take all endeavour to dispose of the same within three months from the date of communication of this order.

7. Let, a copy of this order be handed over to the petitioner for information.
