The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
From a commercial pick-up van of the petitioner, liquor was recovered and driver and cleaner of the vehicle were arrested at the spot.
Submission is that the F.I.R would reveal that the vehicle was to be used for the purpose of carrying chicks. Petitioner had no knowledge as what the driver had kept on the vehicle. Petitioner has got no criminal antecedent. Hence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of

No.85601 of 2019(2) dt.24-01-2020 2/2 thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Excise Case No. 29 of 2019 arising out of Kaler Police Station Case No. 01 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also both the bailors shall be resident of the territorial jurisdiction of the learned court below.
