JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2020 Heard learned counsel for the petitioner and learned counsel for the State, through Virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Excise Case No. 1100 of 2019 arising out of Kaler P.S. Case No.68 of 2019, registered for the offence punishable under Sections 467, 468, 471/34 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition & Excise Act, 2018.

The police has recovered 3152 liters of liquor from a vehicle, however, counsel for the petitioner submits that the petitioner was driving the vehicle having no knowledge what was loaded therein and he is in judicial custody since 06.10.2019 having no criminal antecedent.

Looking to the entire facts and circumstances of the

Patna High Court CR. MISC. No.616 of 2020(5) dt.09-07-2020 2/2 case, this Court is not inclined to grant bail to the petitioner for the present.

Accordingly, the prayer for bail is rejected for the present.

However, he may renew his prayer for bail after completion of one year in judicial custody.
