The petitioner apprehends his arrest in Sanjhauli P.S. Case No.124 of 2019 registered under Sections 467, 468, 472 and 420 of the Indian Penal Code.

Dineshwar Singh, the Chairman of Executive and Managing Committee of Nal Jal Yojna alleged that he issued a cheque bearing no.237857 of Rs.7,500/- in favour of the petitioner for execution of the work but the petitioner withdrew Rs.8,07,500/- by making interpolation in the cheque. The learned counsel for the petitioner submits that it is not the true facts. The petitioner was entrusted to execute the work of Rs.18,89,037/-. The informant got four cheques of Rs.17,32,000/- and Rs.1,57,037/- is still lying due against the petitioner but the informant is silent about the issuance of other

Patna High Court CR. MISC. No.85423 of 2019(3) dt.28-08-2020 2/2 cheques. It is further submitted that there is no interpolation in cheque no.237857. Through cheque no.237857 only Rs.7,500/- was withdrawn.

It appears that investigating officer has not collected any material nor verified from the Bank about the withdrawal of four cheques by the petitioner or any interpolation made in cheque no.237857.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramganj, District-Rohtas at Sasaram in connection with Sanjhauli P.S. Case No.124 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
