The petitioner seeks regular bail in connection with Excise Case No. 117 of 2019 arising out of Jehanabad P.S. Case No. 71 of 2019 for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 190 liters of illicit liquor from an un-constructed house.

The learned counsel for the petitioner has submitted that neither any recovery of illicit liquor has been made from the house of the petitioner nor the said unconstructed house belongs to the petitioner. It is further submitted that though the petitioner is an accused in two other cases, but he is on bail in the said two cases. Lastly, it is submitted that the petitioner is languishing in

Patna High Court CR. MISC. No.85680 of 2019(3) dt.14-01-2020 2/2 custody since 5.11.2019.

Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum Special Judge, Excise, Jehanabad in connection with Excise Case No. 117 of 2019 arising out of Jehanabad P.S.
