The petitioner seeks regular bail in connection with Udwantnagar (Gajrajganj) P.S.Case No.338 of 2019 dated 27.8.2019 registered for offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code. As per the FIR, brother of the informant had gone with the petitioner and he did not return and next day the dead body was found.
Submission of the learned counsel for the petitioner is that the materials collected during the investigation discloses that the informant has come to inquire about the brother on the same night and he has not found the same and thereafter he searched him to his relationship's house and the dead body was
Patna High Court CR. MISC. No.515 of 2020(3) dt.20-02-2020 2/2 found on the same day in the night and except that there is absolutely nothing against the petitioner. He is in custody since 28.8.2019. Charge sheet has been submitted.
Heard learned A.P.P. who has opposed the prayer for bail.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in connection with Udwantnagar (Gajrajganj) P.S.case No.338 of 2019 dated 27.8.2019..
With the above direction, this application is allowed.
