Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier prayer for bail was refused to the petitioner on 17.01.2018 in Cr. Misc. No. 56288 of 2017 as the petitioner was main assailant of the deceased. Petitioner is in custody since 01.07.2017.

The report of the learned Trial Judge would reveal that the charges were framed on 26.06.2018. However, only one prosecution witness has been examined up till now. Considering the period already undergone by the

No.595 of 2020(3) dt.07-10-2020 2/2 petitioner as well as the fact that the trial is not likely to conclude in near future due to COVID effect, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 125 of 2018 arising out of Dhansoi Police Station Case No. 106 of 2017, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
