In this case, the petitioner is seeking anticipatory bail in connection with Kotwa P.S. Case No.190 of 2019, registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

Allegation has been made that after seeing the police party, the accused persons started fleeing away, but on chase, one person was apprehended with theft motorcycle, who disclosed the name of the petitioner, who succeeded in fleeing away.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.

However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
