Petitioner is in custody in connection with Murar P.S. Case No. 54 of 2019 for the offence under sections 341, 147, 148, 149, 307 of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 22.9.2019.

Learned counsel submits that the allegation of firing is against the petitioner and one unknown person. Referring to injury report, learned counsel submits that kind of injury sustained is not attributable to the petitioner. Considering the fact that petitioner has no criminal

No.85922 of 2019(2) dt.28-01-2020 2/2 antecedent and he has remained in custody for more than two months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1 Court No.04, Buxar, in connection with Murar P.S. Case No. 54 of 2019 subject to the condition that bailors should be family members of the petitioner and the petitioner shall extend full cooperation in the early disposal of the case. In the event, the petitioner neglects or fails to attend the court proceeding on two consecutive dates without any cogent reason, liberty shall be available to the court below to cancel the bail bonds of the petitioner.
