The learned counsel for the petitioner, at the outset, has submitted that there is a mistake in paragraph 1 of the bail petition in as much as in place of Revilganj P. S. Case No. 316 of 2019, wrongly Panapur P. S. Case No. 316 of 2019 has been typed.

Since the Courts are closed and the proceedings are being conducted through Video Conference, the aforesaid mistake cannot be corrected physically. The petitioner seeks bail in anticipation of his

Patna High Court CR. MISC. No.87370 of 2019(4) dt.17-08-2020 2/3 arrest in connection with Revilganj P. S. Case No. 316 of 2019, instituted for the offences under Sections 341, 323, 386, 307, 379 and 34 of the Indian Penal Code. The petitioner has not been named in the F.I.R. and his implication in the present case is only on the basis of recovery of a motorcycle from near the place of occurrence.

The learned counsel for the petitioner has submitted that the motorcycle was parked near the tea stall which is run by the petitioner.

The petitioner has clean antecedents.

Regard being had to the nature of accusation and taking into account the fact that the petitioner is otherwise employed and an Operator in Bridge Construction Company for the last five years and his implication in this case is only on the basis of suspicion, he, in the event of his arrest or surrender before the court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the

Patna High Court CR. MISC. No.87370 of 2019(4) dt.17-08-2020 3/3 sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Shri Pramod Ranjan, J.M., 1st Class, Saran, Chhapra in connection with Revilganj P. S. Case No. 316 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
