Singh No. 1, learned counsel for the petitioner, Mr. Brajnandan Kumar Tiwari for the informant and learned APP for the State. The petitioner, who is the husband of opposite party no. 2, seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 23 of 2019 dated 18.06.2019 instituted for the offences under Sections 341, 323, 498(A) and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. This Court has been informed that concilliation proceedings between the spouses has failed. Regard being had to the nature of accusation against the petitioner, I am not inclined to grant

Patna High Court CR. MISC. No.86668 of 2019(3) dt.19-06-2020 2/2 anticipatory bail to him.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioner surrenders before the court below and seeks bail, his petition shall be considered on its own merits without being prejudiced by the fact that, the present petition has not been entertained.
