JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Laxmipur P.S. Case No. 93 of 2013 registered for the offences punishable under Sections 395, 412 of the Indian Penal Code. Petitioner is not named in the first information report and the impugned order goes to show that name of petitioner surfaced in confessional statement of co-accused Damodar Yadav. Furthermore, the impugned order goes to show that for the first time warrant against the petitioner was issued on 09.07.2019. Moreover, the impugned order also reveals that some of the co-accused have already been acquitted. Petitioner does not have any criminal antecedent.

No.86937 of 2019(2) dt.14-02-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar Raj, learned Judicial Magistrate, 1st Class, Jamui in Laxmipur P.S. Case No. 93 of 2013, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) shahzad/- U T
