The petitioner seeks regular bail in connection with Nawada (Kadirganj) P.S.case No.683 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 1089 ltrs. of liquor from the Mini Truck of the co-accused, who disclosed the name of the petitioner..

Submission of the learned counsel for the petitioner is that he has nothing to do with the seized articles or with the Truck. He has been named only on the basis of confession of the co-accused and he is in custody for about two months and the other co-accused persons have been granted privilege of bail

Patna High Court CR. MISC. No.85321 of 2019(2) dt.06-01-2020 2/2 by Co-ordinate Benches of this Court, vide order dated 9.8.2019 passed in Cr. Misc. No.50122/19 and order dated 22.10.2019 passed in Cr. Misc. No.67446/19 .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge, Nawada in connection with Nawada (Kadirganj) P.S.Case No.683 of 2019 with condition to co-operate in disposal of the trial.

With the aforesaid observation, this application is allowed.
